1. Scope and subject matter

These Terms of Use govern the use of the software "Omnus" (hereinafter "Software"), provided by Felix Kempf / Lolax (www.lolax.de) (hereinafter "Provider"). The product is available at omnus.lolax.de. The Software is currently offered as a free beta version for end users.

2. Bring-Your-Own-Key (BYO) and third-party costs

The Software includes features based on artificial intelligence. To use these features, users must provide their own API keys ("Bring-Your-Own-Key") from third-party providers (e.g. OpenAI) within the Software. Costs arising from use of those API keys are billed by the respective third-party provider and are borne solely by the user. The Provider assumes no liability for costs incurred through API usage.

2a. Bring-Your-Own-Cloud (BYO-Cloud)

The Software may offer optional cloud sync via a user-provided cloud drive ("Bring-Your-Own-Cloud"). Connecting a cloud account is voluntary. Sync occurs between the user's device and the chosen third-party cloud provider. The Provider does not operate that cloud storage and assumes no liability for availability, integrity, or costs of the user's cloud service.

3. Beta phase and availability

The Software is in a beta phase. This means it is under continuous development and may contain bugs. There is no claim to a particular quality, functionality, or availability of the Software. The Provider reserves the right to discontinue operation of the Software in whole or in part at any time, or to change features.

4. Limitation of liability

The Software is provided free of charge ("as is"). The Provider is liable only for intent and gross negligence. For ordinary negligence, the Provider is liable only in the event of a breach of an essential contractual obligation (cardinal duty) the fulfillment of which is a prerequisite for the proper performance of the contract. Liability for data loss is limited to typical recovery effort.

5. Copyright and license

The Software and related materials are protected by copyright. The user is granted a simple, non-transferable right to use the Software for personal, non-commercial purposes. Reproduction, distribution, or decompilation of the Software without the Provider's express consent is prohibited, except where mandatory law expressly permits such acts. Omnus is proprietary software; availability on GitHub does not constitute an open-source license.

6. Changes to these Terms

The Provider reserves the right to amend these Terms of Use at any time. Users will be informed appropriately of material changes.

7. Governing law

These Terms and any disputes arising from or in connection with them are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules. Mandatory consumer protection provisions of the user's country of residence remain unaffected where applicable.

1. Geltungsbereich und Vertragsgegenstand

Diese Nutzungsbedingungen regeln die Nutzung der Software „Omnus“ (nachfolgend „Software“), bereitgestellt von Felix Kempf / Lolax (www.lolax.de) (nachfolgend „Anbieter“). Das Produkt ist erhältlich unter omnus.lolax.de. Die Software wird derzeit als kostenlose Beta-Version für Endnutzer bereitgestellt.

2. Bring-Your-Own-Key (BYO) und Drittanbieter-Kosten

Die Software beinhaltet Funktionen, die auf Künstlicher Intelligenz basieren. Zur Nutzung dieser Funktionen müssen Nutzer eigene API-Schlüssel („Bring-Your-Own-Key“) von Drittanbietern (z. B. OpenAI) in der Software hinterlegen. Die Kosten, die durch die Nutzung dieser API-Schlüssel entstehen, werden vom jeweiligen Drittanbieter in Rechnung gestellt und sind vom Nutzer selbst zu tragen. Der Anbieter der Software übernimmt keine Haftung für Kosten, die durch die API-Nutzung entstehen.

2a. Bring-Your-Own-Cloud (BYO-Cloud)

Die Software kann optional eine Cloud-Synchronisation über ein vom Nutzer bereitgestelltes Cloud-Drive („Bring-Your-Own-Cloud“) anbieten. Die Verbindung eines Cloud-Kontos ist freiwillig. Die Synchronisation erfolgt zwischen dem Gerät des Nutzers und dem gewählten Drittanbieter. Der Anbieter betreibt diesen Cloud-Speicher nicht und übernimmt keine Haftung für Verfügbarkeit, Integrität oder Kosten des Cloud-Dienstes des Nutzers.

3. Beta-Phase und Verfügbarkeit

Die Software befindet sich in einer Beta-Phase. Dies bedeutet, dass die Software fortlaufend weiterentwickelt wird und Fehler (Bugs) enthalten kann. Ein Anspruch auf eine bestimmte Beschaffenheit, Funktionsfähigkeit oder Verfügbarkeit der Software besteht nicht. Der Anbieter behält sich das Recht vor, den Betrieb der Software jederzeit ganz oder teilweise einzustellen oder Funktionen zu ändern.

4. Haftungsbeschränkung

Die Software wird kostenlos („as is“) zur Verfügung gestellt. Der Anbieter haftet nur für Vorsatz und grobe Fahrlässigkeit. Für leichte Fahrlässigkeit haftet der Anbieter nur bei Verletzung einer wesentlichen Vertragspflicht (Kardinalpflicht), deren Erfüllung die ordnungsgemäße Durchführung des Vertrags überhaupt erst ermöglicht. Die Haftung für Datenverlust wird auf den typischen Wiederherstellungsaufwand beschränkt.

5. Urheberrecht und Nutzungsrechte

Die Software und die dazugehörigen Materialien sind urheberrechtlich geschützt. Dem Nutzer wird ein einfaches, nicht übertragbares Recht eingeräumt, die Software für persönliche, nicht-kommerzielle Zwecke zu nutzen. Eine Vervielfältigung, Verbreitung oder Dekompilierung der Software ist ohne ausdrückliche Zustimmung des Anbieters untersagt, soweit nicht zwingendes Recht etwas anderes erlaubt. Omnus ist proprietäre Software; die Verfügbarkeit auf GitHub begründet keine Open-Source-Lizenz.

6. Änderungen der Nutzungsbedingungen

Der Anbieter behält sich vor, diese Nutzungsbedingungen jederzeit zu ändern. Bei wesentlichen Änderungen werden die Nutzer angemessen informiert.

7. Anwendbares Recht

Für diese Nutzungsbedingungen und alle Streitigkeiten daraus gilt das Recht der Bundesrepublik Deutschland unter Ausschluss der Kollisionsnormen. Zwingende Verbraucherschutzvorschriften des Wohnsitzlandes des Nutzers bleiben unberührt, soweit anwendbar.
